Terms and Conditions of Use

IMPORTANT — PLEASE READ CAREFULLY. These Terms and Conditions of Use ("Terms") are a legally binding contract between you and My Cycle Safe AI. They include important provisions about medical information, the limits of the Service, the Safe Days Calculator, the "Your Doctor" feature, AI predictions, limitations of liability, and dispute resolution. Section 16 contains a binding arbitration clause and a class-action waiver that affect how disputes between you and us are resolved. By creating an account, ticking the "I agree" box, or otherwise using the Service, you confirm that you accept these Terms. If you do not agree, do not use the Service.

1. About These Terms and Who We Are

My Cycle Safe AI ("My Cycle Safe", "we", "us", or "our") provides an AI-powered menstrual cycle tracking website, calculator, and related services available at mycyclesafe.ai (the "Service"). The Service is operated by mycyclesafe.ai, incorporated under the laws of India, with its principal place of business at Coimbatore, Tamil Nadu, India.

These Terms govern your access to and use of the Service. They incorporate by reference our Privacy Policy, our Cookie Notice, and any additional rules or policies we publish on the Service for specific features. If there is a conflict between these Terms and a feature-specific policy, the feature-specific policy controls for that feature only.

2. Eligibility

To use the Service you must:

• Be at least 16 years old, or the age of digital consent in your country if it is higher;
• Have the legal capacity to enter into a binding contract;
• Not be barred from using the Service under the laws of your country, the country in which you reside, or the country from which you access the Service;
• Not have been previously suspended or removed from the Service by us.

If you are using the Service on behalf of someone else (for example, a minor in your care), you confirm that you are authorised to do so and that you accept these Terms on their behalf as well as on your own.

3. Your Account

Some features (such as saving your cycle history and syncing across devices) require you to create an account. When you do, you agree to:

• Provide accurate, current, and complete information;
• Keep your account information up to date;
• Choose a strong password and keep it confidential;
• Be responsible for all activity that takes place under your account;
• Notify us immediately at [email protected] if you suspect any unauthorised use.

You may not share your account, sell or transfer it, or permit anyone else to use it. We are not liable for any loss arising from unauthorised use that we could not reasonably have prevented.

4. What the Service Does (and Does Not) Do

4.1 Cycle Tracking and Predictions

The Service lets you log information about your menstrual cycle, symptoms, mood, and related signals, and uses statistical and machine-learning models to estimate things like your next period start date, your fertile window, and your current cycle phase. These outputs are estimates based on the data you provide and on patterns observed across users. They are not medical diagnoses or guarantees.

4.2 The Safe Days Calculator

The "Safe Days Calculator" lets you input your last period start date and your typical shortest and longest cycle lengths to receive an estimate of when you may be ovulating and which days are statistically less likely to result in conception based on the calendar (rhythm) method.

THE SAFE DAYS CALCULATOR IS NOT A METHOD OF CONTRACEPTION. Calendar-based methods of fertility awareness, including the rhythm method, have a typical-use failure rate of approximately 13% to 24% per year, meaning that out of every 100 people who use the method as their primary form of contraception for one year, between 13 and 24 may become pregnant. The calculator does not account for irregular cycles, illness, stress, hormonal contraception, breastfeeding, perimenopause, or many other factors. The calculator does NOT protect against sexually transmitted infections.

If you do not want to become pregnant, you should use a clinically validated method of contraception and discuss your options with a qualified healthcare provider. If you are trying to conceive and are having difficulty, please consult a fertility specialist; the Safe Days Calculator is not a fertility-treatment tool.

4.3 The "Your Doctor" Feature

The "Your Doctor" feature lets you submit a free-text description of a symptom or health concern, choose a medical specialty, and provide an email address. We use this information to put you in contact with a partner clinic or clinician who may follow up with you, depending on your jurisdiction.

You agree that:

• We are not a healthcare provider. My Cycle Safe AI does not practise medicine, does not employ the partner clinicians, and does not supervise the medical advice they may give you. The Service is a referral and intake tool, not a clinical service.
• No doctor-patient relationship is created with us. Your use of the Service, including submitting the "Your Doctor" form or reading any informational content on the Service, does not by itself create a doctor-patient or healthcare-provider relationship between you and My Cycle Safe AI.
• Any clinical relationship is with the partner. Once you are connected to a partner, the relationship, the standard of care, the confidentiality of communications, billing, and follow-up are governed by the partner's own terms and the laws of the jurisdiction in which the partner practises.
• Not for emergencies. The "Your Doctor" feature is not designed for urgent or emergency medical situations. If you are or may be experiencing a medical emergency — for example, severe abdominal pain, heavy or sudden bleeding, signs of an ectopic pregnancy, suicidal thoughts, or any other condition that may threaten your life or wellbeing — call your local emergency number or go to the nearest emergency department immediately.

4.4 Informational Content

The Service may include articles, explanations of cycle phases, and educational content. This content is provided for general information and educational purposes only. It is not medical advice, diagnosis, or treatment, and it is not a substitute for consultation with a qualified healthcare professional.

4.5 Service Changes

We are continually improving the Service. We may add, change, suspend, or remove features at any time, including for security, legal, or commercial reasons. Where a change is material and adverse to you, we will give you reasonable advance notice and, where required by law, an opportunity to download your data before the change takes effect.

5. Medical Disclaimer

IMPORTANT MEDICAL DISCLAIMER. THE SERVICE PROVIDES INFORMATIONAL TOOLS TO HELP YOU UNDERSTAND YOUR CYCLE. IT IS NOT A MEDICAL DEVICE, IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR CONDITION, AND IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE FROM A QUALIFIED HEALTHCARE PROVIDER. CYCLE PREDICTIONS AND THE SAFE DAYS CALCULATOR ARE STATISTICAL ESTIMATES, NOT GUARANTEES. NEVER DISREGARD PROFESSIONAL MEDICAL ADVICE OR DELAY SEEKING IT BECAUSE OF SOMETHING YOU READ OR LEARNED ON THE SERVICE.

You should consult a qualified healthcare provider:

• For any medical concern, including unusual or persistent bleeding, severe pain, missed periods, suspected pregnancy, or fertility concerns;
• Before starting, stopping, or changing any treatment, medication, or contraceptive method;
• Before relying on the Service for family-planning purposes — whether to avoid or to achieve pregnancy.

6. Acceptable Use

When using the Service, you agree that you will not:

• Use the Service in violation of any applicable law or regulation;
• Submit false, misleading, or fraudulent information, including in the "Your Doctor" form;
• Impersonate another person or misrepresent your relationship with any person or organisation;
• Probe, scan, or test the vulnerability of the Service, breach any security measures, or attempt to access accounts or data that are not yours;
• Use any robot, scraper, or other automated means to access the Service, except for clearly identified non-aggressive crawlers complying with our robots.txt;
• Reverse-engineer, decompile, or disassemble any part of the Service, except to the extent that applicable law permits despite this restriction;
• Use the Service to develop a competing product, or to train an artificial-intelligence model;
• Use the Service to harass, threaten, or harm any person, including other users or our staff;
• Upload, transmit, or distribute any content that is illegal, infringing, defamatory, obscene, or otherwise harmful;
• Interfere with or disrupt the integrity or performance of the Service or the data it contains.

We may investigate any conduct that may violate these Terms and may take any action we consider appropriate, including warning you, suspending or terminating your account, removing content, and reporting activity to the authorities.

7. Your Content and Licence to Us

"Your Content" means everything you submit to the Service, including cycle data, symptoms, the description you submit through the "Your Doctor" form, and any feedback you give us.

Your Content remains yours. We do not claim ownership of it.

To run the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, copy, transmit, display, and process Your Content for the purposes described in these Terms and our Privacy Policy. This licence is limited to what is necessary to provide the Service to you and to develop and improve the Service in the ways the Privacy Policy explains. The licence ends when you delete Your Content or your account, except for:

• Backup or archival copies that we are required to keep for legal, regulatory, or security reasons, until our retention period expires;
• De-identified or aggregated information that cannot be linked back to you, which may be retained indefinitely.

You represent and warrant that you have the right to submit Your Content and that doing so does not violate any law or third-party right.

7.1 Feedback

If you send us suggestions, ideas, or feedback about the Service, you agree that we may use them without obligation to you. We will not identify you in connection with feedback unless you give us permission.

8. Intellectual Property

The Service, including its software, design, text, graphics, logos, trade marks, and the underlying machine-learning models and algorithms, is owned by My Cycle Safe AI or its licensors and is protected by intellectual-property laws.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial purposes, subject to your compliance with these Terms. No other rights are granted, expressly or by implication.

You may not copy, modify, distribute, sell, or lease any part of the Service, and you may not remove any copyright, trade-mark, or other proprietary notice.

8.1 Trade Marks

"My Cycle Safe", "My Cycle Safe AI", and our logos are trade marks of mycyclesafe.ai. You may not use them without our prior written consent.

8.2 Copyright Complaints

If you believe content on the Service infringes your copyright, please send a notice with the information required by the US Digital Millennium Copyright Act (DMCA) — or the equivalent law in your jurisdiction — to [email protected].

9. Third-Party Services and Links

The Service may contain links to third-party websites, services, or content that we do not control. We are not responsible for them. Their inclusion does not imply our endorsement. Your use of any third-party service is subject to that service's own terms and privacy practices, and you access it at your own risk.

10. Paid Features, Subscriptions, and Refunds

At present, the core Service is provided free of charge. If we introduce paid features in the future, the following will apply unless we publish different terms for a specific paid feature:

• Prices, billing cycles, and any free-trial terms will be shown at the point of purchase;
• Subscriptions auto-renew at the end of each billing period unless cancelled at least 24 hours before renewal;
• You can cancel a subscription at any time from your account settings; cancellation takes effect at the end of the current billing period;
• Except where required by law (for example, a 14-day cooling-off right under EU consumer law for digital content not yet delivered), payments are non-refundable;
• Taxes are charged in addition to the listed price where required by law.

We reserve the right to change prices on prospective billing cycles with reasonable advance notice.

11. Privacy

Our Privacy Policy at mycyclesafe.ai/privacy describes how we collect, use, share, and protect your personal information. By using the Service you confirm that you have read and understood the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

12. Suspension and Termination

12.1 By You

You may stop using the Service and delete your account at any time from your account settings. Deletion removes your personal cycle data from active systems on the schedule described in the Privacy Policy.

12.2 By Us

We may suspend or terminate your account, with or without notice, if:

• We reasonably believe you have breached these Terms or any applicable law;
• Your conduct exposes us, other users, or third parties to legal liability or technical risk;
• We are required to do so by a court order, regulator, or applicable law;
• We discontinue the Service or a feature in your jurisdiction.

Where the breach is curable and circumstances allow, we will give you a chance to fix it before suspending or terminating. We will give you a reasonable opportunity to export your data before deletion, except where doing so would prevent us from complying with the law.

12.3 Effect of Termination

Sections that by their nature should survive termination — including Sections 5 (Medical Disclaimer), 7 (Your Content), 8 (Intellectual Property), 13 (Disclaimers), 14 (Limitation of Liability), 15 (Indemnification), 16 (Disputes), and 17 (General) — will survive.

13. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MY CYCLE SAFE AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WITHOUT LIMITING THE ABOVE, WE DO NOT WARRANT THAT: (a) the Service will be uninterrupted, secure, or error-free; (b) defects will be corrected; (c) the Service will be free of viruses or other harmful components; (d) cycle predictions, fertility-window estimates, or "Your Doctor" matches will be accurate, complete, reliable, or appropriate for your circumstances; or (e) the Service will achieve any particular result, including pregnancy or pregnancy avoidance.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions in this section apply only to the extent permitted by law, and you may have additional rights as a consumer that these Terms do not affect.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL MY CYCLE SAFE AI OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:

• Indirect, incidental, special, consequential, exemplary, or punitive damages;
• Loss of profits, revenue, data, goodwill, or anticipated savings;
• Any damages arising from unintended pregnancy, failure to conceive, missed diagnoses, delays in seeking medical care, or any other medical outcome connected to your use of the Service;
• Any damages arising from the acts or omissions of partner clinicians or other third parties;
• Any damages arising from your inability to access or use the Service.

OUR TOTAL CUMULATIVE LIABILITY to you for any and all claims arising out of or relating to the Service or these Terms, whether in contract, tort, statute, or otherwise, will not exceed the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) one hundred US dollars (USD $100).

The limitations and exclusions in this section apply even if a remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of liability for certain types of harm — for example, death or personal injury caused by negligence, fraud, or other liability that cannot be excluded by law. Nothing in these Terms is intended to exclude or limit any liability that cannot be excluded or limited under applicable law.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless My Cycle Safe AI, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

• Your breach of these Terms or any policy incorporated by reference;
• Your violation of any law or third-party right;
• Your Content;
• Your misuse of the Service.

We may take over the defence of any claim subject to indemnification, in which case you will cooperate with our defence. You may not settle any such claim without our prior written consent.

16. Governing Law and Disputes

16.1 Governing Law

These Terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of India, without regard to its conflict-of-laws rules. The application of the United Nations Convention on Contracts for the International Sale of Goods is excluded.

16.2 Informal Resolution First

Before filing a formal claim, you agree to first contact us at [email protected] with a description of the dispute and the relief you are seeking, and to give us at least 60 days to resolve it informally. We will use the same process before bringing any claim against you.

16.3 Binding Arbitration (US Users)

If you are a resident of the United States, any dispute that is not resolved informally will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in Coimbatore, Tamil Nadu, India or, at your election, in the US county in which you reside. The arbitrator may award any relief that a court could award. Judgment on the award may be entered in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.

16.4 Class-Action Waiver

YOU AND MY CYCLE SAFE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. Where the law of your jurisdiction does not permit a class-action waiver, this clause does not apply to that extent.

16.5 Opt-Out of Arbitration

You may opt out of the arbitration agreement and the class-action waiver in Section 16.3 and 16.4 by sending a written notice to [email protected] within 30 days of first accepting these Terms. The notice must include your name, the email address associated with your account, and a clear statement that you wish to opt out.

16.6 Courts (Non-US Users and Excluded Claims)

If arbitration does not apply to you (for example, because you are a consumer protected by mandatory law in the EU, the UK, or another jurisdiction), or for claims that under applicable law cannot be arbitrated, the courts of Coimbatore, Tamil Nadu, India have exclusive jurisdiction, except that consumers may bring proceedings in the country in which they reside, as required by mandatory consumer law.

17. General

17.1 Changes to These Terms

We may update these Terms from time to time. If we make a material change we will give you reasonable advance notice — for example, by email or through an in-product banner — before the change takes effect. Continued use of the Service after the effective date means you accept the updated Terms. If you do not accept the updated Terms, you must stop using the Service before the effective date.

17.2 Entire Agreement

These Terms, together with the Privacy Policy and any policy expressly incorporated, are the entire agreement between you and My Cycle Safe AI about the Service, and replace all earlier agreements on the same subject.

17.3 Severability

If any provision of these Terms is held to be invalid or unenforceable, the rest of the Terms will remain in full force and effect, and the invalid provision will be replaced with a valid one that comes closest to the original intent.

17.4 No Waiver

Our failure to enforce any right or provision will not be a waiver of that right or provision.

17.5 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganisation, or sale of assets, on notice to you.

17.6 Force Majeure

We will not be liable for delay or failure to perform that is caused by events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, pandemic, government action, network or power failures, or denial-of-service attacks.

17.7 Notices

Notices to you may be given by email to the address associated with your account, by in-product notice, or by posting on the Service. Notices to us must be sent to [email protected] with a copy to mycyclesafe.ai, Coimbatore, Tamil Nadu, India.

17.8 Language

These Terms are written in English. If we provide a translation, the English version controls in the event of any conflict, except where mandatory law requires otherwise.
